Product Return, Consumer Rights and Conditions

Product Return Conditions and Buyer Obligations 

a) By requesting to purchase a product through 'Buy', the buyer is deemed to have accepted the product description, the sales conditions, and procedures set by the seller. 

b) The buyer will ensure that the payments for the products purchased are made to the Secure Account managed by Bi+Smart, using the Market Protection System Service, where the payment will be blocked until the transaction between the buyer and seller is completed, the product is physically delivered by the seller, and accepted by the buyer.

c) After the buyer has made the payment to the Secure Account, the seller must enter the shipping information of the product on the site within 3 business days +24 hours. The buyer agrees, declares, and undertakes to request the transfer of the product price in the Secure Account to the seller's account upon receiving the product within 3 (three) business days + 24 hours from when the seller enters the shipping information on the site, or if the buyer refuses the product sent by the seller, to return the product to the seller and request the product price to be refunded by Bi+Smart. If the buyer sends the product back to the seller for any reason, they agree, declare, and undertake that the sale price of the related product held in the Secure Account will be sent back to the buyer's account only after Bi+Smart is notified by the seller that the product has been received back. 

Products customized for the buyer's request or clear personal needs and not suitable for return, undergarments, swimsuit bottoms, makeup materials, disposable products, products that are prone to spoilage or may pass their expiration date, cannot be returned if their packaging is opened by the BUYER after delivery, for health and hygiene reasons, according to regulations. Also, the right of withdrawal cannot be used for services that have begun with the consumer's approval before the end of the withdrawal period, as per regulations.

d) The buyer accepts and declares that Bi+Smart is not and does not have to be aware of whether the products offered for sale by sellers on the site are defective and/or smuggled and/or from Prohibited Products, including but not limited to their quality, originality, and the accuracy of the written and/or visual descriptions used in the product's promotion, and that it has no obligation to guarantee and warrant these.

e) The buyer agrees, declares, and undertakes that Bi+Smart has no responsibility or obligation if the seller decides to withdraw from selling and delivering the product at any stage of the buying-selling process on the site, for any reason, and that the buyer cannot demand the provision of the product or a similar one or any compensation from Bi+Smart under any circumstances. 

f) The buyer agrees, declares, and undertakes that the sale price sent to the Secure Account for transfer to the seller, upon the occurrence of the conditions described in this User Agreement, will be transferred to the bank account reported by the seller to Bi+Smart after deducting the VAT included service fee commission and after fulfilling the obligations stated in section 5.1.1 (c) of this User Agreement, and that Bi+Smart will not perform any transactions or dispositions on behalf of the buyer with the buyer's money in the Secure Account during this process. 

g) The buyer agrees, declares, and undertakes that Bi+Smart can use their user information within the framework of the Law on the Protection of the Consumer and the Regulation on Distance Contracts. 

h) The buyer agrees, declares, and undertakes that they will not be a party to any dispute arising from the pre-information form and the distance contract; that any demand related to the pre-information form and the distance contract and/or the product sold will be directed only to the Seller; and that Bi+Smart has no legal liability in relation to these demands. 

ı) The buyer confirms, understands, and accepts that Bi+Smart, not being a party to the sales contract between the buyer and the seller and not having any transaction, commitment, and obligation related to the sales relationship and the product sold, has no transaction, commitment, and obligation under the Law on the Protection of the Consumer, whether it be the seller, provider, manufacturer, producer, distributor, agent, advertiser, media institution, or any other title.
